Terms of Service

1. Service Description

XPmetric ("the Service") is a web analytics platform that gamifies website traffic data. It is operated at xpmetric.com. The Service allows you to track page views, visitor activity, and other analytics events on your websites, while earning experience points (XP), leveling up, and unlocking achievements.

2. Acceptance of Terms

By creating an account or using XPmetric, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

3. Account Responsibilities

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account
• One account per person — do not create multiple accounts
• You must be at least 16 years old to use the Service
• You are responsible for all activity that occurs under your account

4. Billing and Subscriptions

• New accounts receive a 14-day free trial with full access
• After the trial, a paid subscription is required to continue using the Service
• Subscriptions are billed monthly or yearly via Stripe
• Subscriptions renew automatically at the end of each billing period
• You can cancel your subscription at any time through the Stripe billing portal
• After cancellation, you have a 7-day grace period to resubscribe before analytics data is deleted
• Each subscription tier includes a monthly event limit — events beyond the limit are still tracked but the dashboard will prompt you to upgrade
• All prices are in USD and shown exclusive of applicable taxes

5. Acceptable Use

You agree not to:

• Send fabricated or spam analytics events
• Use the Service to track websites you do not own or control
• Use the Service for any illegal purpose or to track illegal content
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Interfere with the Service's infrastructure or other users' use of the Service
• Resell or redistribute the Service without written permission

6. Intellectual Property

XPmetric and its original content, features, and functionality are owned by XPmetric and are protected by applicable intellectual property laws. You retain full ownership of your analytics data and the content on your tracked websites.

7. Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee any specific uptime or service level. We will make reasonable efforts to keep the Service available, but maintenance windows, updates, and unforeseen issues may cause temporary interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, XPmetric shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

• You may delete your account at any time from your Settings page
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted in accordance with our Privacy Policy

10. Changes to Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via email or through the Service. Continued use of XPmetric after changes constitutes acceptance of the updated terms.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany and applicable European Union regulations. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Germany.
